Introduction:
This purchase is governed by the following standard terms and conditions for consumer purchases of goods over the internet. A consumer purchase refers to the sale of goods to a consumer who is not primarily acting as part of a business activity, and where the seller operates commercially through online sales. The contract is prepared and recommended for use by the Consumer Authority.
Consumer purchases over the internet are mainly regulated by the Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act, and the E-commerce Act. These laws grant the consumer non-waivable rights. The terms of this contract are not intended to limit these statutory rights but outline the most important rights and obligations of both parties. The seller may offer better terms than those stated here.
If the contract does not directly address an issue, it shall be supplemented by relevant legal provisions.
1. The Agreement
The agreement between the buyer and the seller consists of the information provided by the seller in the online store’s ordering solution (including details about the product’s nature, quantity, quality, properties, price, and delivery terms), any direct correspondence between the parties (such as emails), and these terms and conditions.
In case of conflict between the information provided in the ordering system, direct correspondence, and these terms, direct correspondence and the ordering system information take precedence, unless this conflicts with mandatory law.
2. The Parties
Seller:
Company Name: BioFriend AS
Address: Sandalssvingen 13, 4022 Stavanger
Email: post@biofriend.no
Organization Number: 933 34 1135
Buyer:
The person placing the order.
3. Prices
The total cost the buyer must pay, including all taxes (VAT, customs duties, etc.) and delivery costs (shipping, postage, invoicing fees, packaging, etc.), will be provided in the ordering system before the order is placed.
(Deliveries to Svalbard or Jan Mayen are sold without VAT. Contact before ordering.)
4. Conclusion of the Agreement
The agreement becomes binding for both parties when the seller receives the buyer’s order.
However, a party is not bound if there has been a typographical or input error in the offer or order, and the other party realized or should have realized that such an error existed.
5. Order Confirmation
The seller shall confirm the order without undue delay by sending an order confirmation to the buyer.
The buyer should check that the confirmation matches the order (quantity, product type, price, etc.). If there is a discrepancy, the buyer should contact the seller as soon as possible.
6. Payment
The seller may request payment once the product is shipped.
If the buyer pays with a credit or debit card, the seller may reserve the amount for up to 4 days from the order date.
If invoicing is offered, the invoice is issued upon shipment and must have a minimum payment term of 14 days from delivery.
7. Delivery
Delivery will take place in the manner, location, and time specified in the ordering system.
If no delivery time is specified, the seller must deliver within a reasonable time, and no later than 30 days after the order. The seller must ensure proper transport to the destination, which is typically the buyer’s address unless otherwise agreed.
8. Risk of the Goods
The risk transfers to the buyer when the product is received. If the buyer fails to collect the product after delivery is made available, the buyer still bears the risk of loss or damage.
9. Right of Withdrawal
The buyer may cancel the purchase according to the Right of Withdrawal Act.
The buyer must notify the seller within 14 days after receiving the product and required information.
If proper information is not provided, the withdrawal period may extend up to 3 months, or up to 1 year if no information is provided at all.
The item must be returned within a reasonable time. The seller must refund the full purchase amount within 14 days after receiving the return. The buyer may be responsible for return shipping costs.
The product must be returned in approximately the same condition and quantity as received, preferably in original packaging.
The right of withdrawal does not apply to perishable goods, items that cannot be returned due to their nature, or sealed audio/video recordings or software if the seal is broken.
10. Duty to Inspect
The buyer should inspect the product upon receipt to ensure it matches the order and is not damaged.
If defects are found, the buyer must notify the seller according to section 11.
11. Complaints
If a defect exists, the buyer must notify the seller within a reasonable time after discovering it. This period can never be shorter than two months.
Complaints must be made within two years of receiving the product, or five years if the product is intended to last significantly longer.
12. Buyer’s Rights in Case of Delay
If delivery is delayed and not due to the buyer, the buyer may:
-
Withhold payment
-
Demand fulfillment
-
Cancel the agreement
-
Claim compensation
13. Buyer’s Rights in Case of Defects
If the product has defects, the buyer may request:
-
Repair
-
Replacement
-
Price reduction
-
Cancellation of the agreement
-
Compensation
14. Seller’s Rights in Case of Buyer’s Breach
If the buyer fails to pay or fulfill obligations, the seller may:
-
Withhold the product
-
Demand fulfillment
-
Cancel the agreement
-
Claim compensation
The seller may also charge interest, collection fees, or fees for uncollected goods.
15. Warranty
Any warranty provided by the seller or manufacturer gives rights in addition to those granted by law.
16. Personal Data
The seller may only collect and store personal data necessary to fulfill the agreement unless the buyer consents otherwise.
17. Dispute Resolution
The parties should attempt to resolve disputes amicably.
The buyer may contact the Consumer Council for assistance.
If no resolution is reached, the case may be brought before the Consumer Disputes Commission, whose decisions become legally binding after four weeks.
